These Terms and Conditions govern the relationship between VIVRE TRAVEL LLC, d/b/a VIVRE TRAVEL (“VIVRE TRAVEL” and/or “our”) and you, the Customer. By making a booking with us or paying any of our fees described below, the purchaser and/or traveler (“Customer” and “passenger” and “you/your”) must read, understand, and agree to these Terms and Conditions. These terms restrict your rights and remedies and provide protection to VIVRE TRAVEL, including warranty disclaimers and liability exclusions. By using VIVRE TRAVEL’s services and this website you acknowledge and agree(a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by you, or members of your group or family, is true and correct. Further, you agree that any violation of these Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable Travel Products. So, if anything is in these Terms and Conditions, including warranty disclaimers and liability exclusions, that you disagree with or are not willing to be bound by, or if something is missing from these Terms and Conditions that you consider essential, then you must not use this website or VIVRE TRAVEL’s services.

CONSENT TO TERMS AND CONDITIONS
Access to and use of the services of VIVRE TRAVEL and our website is subject to acceptance of these terms and conditions Terms and Conditions. By accessing, using or obtaining any content, products, or services through our offices or through our website, you agree to be bound by these terms.
IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR VIVRE TRAVEL’S SERVICES. No alterations to these terms and conditions may be made by any VIVRE TRAVEL employee, advisor, representative or agent, unless in writing by an authorized officer of VIVRE TRAVEL.

USE OF VIVRE TRAVEL ACCESS AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with VIVRE TRAVEL by any means, including our website in accordance with all terms and conditions herein. You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of VIVRE TRAVEL communications by minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with VIVRE TRAVEL is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities provided by VIVRE TRAVEL shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.

Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms and conditions of purchase imposed by VIVRE TRAVEL and any supplier with whom you elect to deal, or with whom VIVRE TRAVEL deals on your behalf, including but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in VIVRE TRAVEL debiting your account for any costs VIVRE TRAVEL incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through VIVRE TRAVEL.

Customer authorizes VIVRE TRAVEL to book on third party travel booking sites to fulfill Customer’s travel requests. Customer ratifies VIVRE TRAVEL’s actions on Customer’s behalf, including acceptance of such third party’s terms and conditions, which limit Customer’s rights, and Customer agrees to be bound by such actions.

In the event of any inconsistency or ambiguity of terms, VIVRE TRAVEL shall benefit from the most favorable term(s) in each instance.

RESERVATION OF RIGHTS: CHANGES TO THESE TERMS AND CONDITIONS
We reserve the right, in our sole discretion and for any reason whatsoever or for no reason, to change these Terms and Conditions at any time. Updated versions of the Terms and Conditions will be posted here on this website and are effective immediately on posting. Please check frequently, especially before you use this website, to see if these Terms and Conditions changed. Use of the website after any changes to the Terms and Conditions constitutes your consent to the changes.

SCOPE & ROLE OF AGENCY. VIVRE TRAVEL does not provide, own, manage, operate, supervise or control the travel services and products that are or may be provided as part of your trip, such as flights, accommodations, cruise, rental cars, packages, or travel insurance (the “Travel Products”). All Travel Products are owned, controlled, operated, or made available by vetted, independent third parties such as destination management companies, airlines, hotels, cruise lines, and tour operators (the “Suppliers”). The Suppliers are solely responsible for the Travel Products as well as any and all benefits, perks, or amenities, including without limitation, resort credits, on-board credits, free specialty dining, spa credits, in-room amenities, etc. The Supplier’s terms, conditions and privacy policies apply to your booking so you must agree to and understand those terms. Your interaction with any Supplier is at your own risk; VIVRE TRAVEL does not bear any responsibility should anything go wrong with your booking or during your travel. Hence, as the traveler, you agree that VIVRE TRAVEL acts only as a booking agent for the Supplier in acquiring transportation, accommodations, cruises, sightseeing and other Travel Products, privileges or services for the travelers’ benefit. VIVRE TRAVEL customarily receives compensation, usually in the form of a commission, for bookings made on its behalf. VIVRE TRAVEL may also receive compensation in the form of travel planning fees, booking fees or other professional service fees which are payable by you.

TRAVELER FURTHER AGREES THAT VIVRE TRAVEL SHALL NOT BE LIABLE FOR ANY INJURY TO PERSON OR PROPERTY, OR ANY OTHER LIABILITY WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY DIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, DIRECT, OR INCIDENTAL DAMAGES IN CONNECTION WITH THE TRAVEL PRODUCTS OR SERVICES BOOKED WITH ANY SUPPLIER THROUGH VIVRE TRAVEL. VIVRE TRAVEL SHALL NOT BE LIABLE FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, BANKRUPTCY, INSOLVENCY, OR NON-PERFORMANCE WHICH MAY OCCUR DUE TO THE FAULT, WILLFUL ACTS OR OMISSIONS, NEGLIGENCE OR OTHERWISE OF ANY SUPPLIER AND/OR VIVRE TRAVEL OR PERSON(S) ENGAGED IN OR RESPONSIBLE FOR ANY TRAVEL PRODUCTS, OR OTHERWISE IN CONNECTION THEREWITH.

SERVICES PROVIDED
VIVRE TRAVEL is an independent travel advisory firm which designs and books customized itineraries to include, as expressly agreed, accommodations, transportation arrangements, and activities. In the months leading up to your departure date, as agreed, VIVRE TRAVEL will accessorize your trip with reservations, spa appointments, and activities. While you are enjoying your trip, VIVRE TRAVEL is monitoring and managing your travels and available either directly or via our on-the-ground partners if you need assistance. As a client of VIVRE TRAVEL, you have exclusive access to valuable amenities at Virtuoso-affiliated properties and other properties where we are "preferred partners" due to our affiliation with Brownell Travel, a Virtuoso Member and member of all leading preferred partnerships currently offered by hoteliers. Once the planning is complete, the arrangements with hoteliers, tour companies, and other suppliers are secured with the credit card provided in the Credit Card Authorization. You will be provided with all payment information and cancellation policies of the suppliers in advance. Final travel documents shall be delivered to you when all invoices have been paid in full.

FEE & PRICING STRUCTURE
VIVRE TRAVEL reserves the right to adjust these fees at any time in its sole discretion.

Design Fee: From $850+ The design fee varies per trip and is based upon the number of travelers, destinations, the level of complication anticipated and other factors. The minimum trip design fee is $850 per week of travel for a group of up to four (4) travelers, for research and development of a custom itinerary recommendation and covers up to two (2) itinerary revisions. The design fee shall be collected prior to the commencement of trip planning.

Trip Management Fee: Varying Range of NET Vendor Pricing depending on location; hotel rates typically will not exceed published rates.

Hotel-Only Research and Booking Fee: $250+

Expedited Planning Fee: (travel requested within 45 days of departure or within 90 days of travel for the Dec. 20 - Jan 10 period): 50% above normal trip design fee or $400+

Hourly Fee for Excessive Revisions to Itinerary and Concierge Services beyond Reasonable Expectations: $200/hour

Airline Ticket Issuance: $150 Domestic and International, capped at $500 per household.

Net Pricing: The consultation fee covers a small portion of our many hours of work and thought creating your trip. VIVRE TRAVEL also earns a commission (“management fee”) on our bookings with suppliers, typically payable after you complete your travel. Where possible, we request NET pricing terms from vendors. This pricing reflects the vendor's fee free or markup or their negotiated rates with hotels, guides, transfer companies etc. without any markup. VIVRE TRAVEL charges a fee on all NET pricing bookings per the Fee Structure below. When NET pricing isn't available because a supplier maintains confidential negotiated rates, VIVRE TRAVEL will quote as a package rate which includes our management fee. In the event a hotel will not pay standard commissions to agencies (very rare and mostly found in small towns in Europe), you agree to pay VIVRE TRAVEL a booking fee in an amount equal to 18% of the nightly rate booked.

Quotes & Cancellation Fee: Prices and availability are subject to change and are not guaranteed until payment is received. Price quotes are applicable to the date and time at which they are received. Quotes are subject to fluctuations in exchange rates and international credit card issuer fees. In the event you cancel your trip after we have your trip under deposit, you will be charged the cancellation fee charged by the hotel, tour company or other supplier. VIVRE TRAVEL may assess a cancellation fee of up to 15% of the total trip cost to cover planning, coordination, and professional services already rendered. All fees paid to VIVRE TRAVEL are non-refundable.

TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS
It is the responsibility of each Customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight found in http://www.tsa.gov/traveler-information/acceptable-ids. Examples: DHS-designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. VIVRE TRAVEL strongly recommends that you take into account that certain countries will not admit a passenger, if his or her passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. The U.S. Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from a contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Customer to miss flight(s), and subsequent scheduled travel bookings on cruises and tours. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required.

Unless otherwise agreed in writing, VIVRE TRAVEL shall not be responsible for obtaining any visas or passport renewals on your behalf and shall not be responsible for any losses incurred by you or the persons you are traveling with in the event that you or any such persons fails to obtain the relevant visa or visas for travel, or fails to have a valid passport that expires no fewer than six (6) months following the date of entry into the final scheduled destination on your itinerary.

INDIVIDUAL ENTRY AND EXIT REQUIREMENTS
Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (See: https://travel.state.gov/content/travel/en/international-travel/International-Travel-Country-Information-Pages.html) VIVRE TRAVEL neither controls nor warrants the issuance of visas related to applicable travel. It is Customer’s responsibility to verify that all the visas required for your trip have been obtained, that the visas for each country are valid for the entry and exit dates of your visit, that your personal details are accurately reflected and that your passport is valid for at least six months beyond the completion date of your trip. Please note that even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors including past criminal record may contribute to the decision of the local immigration official(s). Should a visa not be issued, VIVRE TRAVEL is not responsible for lost
payments made toward the contemplated trip. We feel it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers. RISKS/SAFETY
Travel to certain destinations may involve greater risk than others. VIVRE TRAVEL urges customers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at

http://www.cbp.gov The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, VIVRE TRAVEL DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CUSTOMER’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CUSTOMER’S OWN RISK.

PAYMENTS AND CANCELLATION
Final payment is due prior to departure according to each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service partners) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to VIVRE TRAVEL in writing. As a result of cancellation, VIVRE TRAVEL’s and third-party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, this website, and each of the supplier’s website.

Cancellation penalties are advised at time of booking and provided to you upon confirmation. If you have any questions, or any penalties are unclear, please contact your VIVRE TRAVEL advisor. All cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from the supplier’s refund.

AIR, CHECK-IN, SCHEDULE RECONFIRMATION. UNLESS SET FORTH IN WRITING, AIRLINE RESERVATIONS ARE NOT INCLUDED IN YOUR TRAVEL PLANS
In such event, it is the Customer’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. VIVRE TRAVEL shall not assume any responsibility for any air and/or ground schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Due to enhanced security and operational delays, it is strongly recommended that you arrive at the airport at a bare minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights, though earlier is recommended particularly at busy international airports.

Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Failure to use a reservation may result in automatic cancelation of all continuing and return flights, as well as forfeiture of airfares.

LATE BOOKINGS
Prospective customers are advised to reserve early to avoid disappointment and additional late booking fees.

NO REFUND FOR UNUSED ARRANGEMENTS
As VIVRE TRAVEL’s prices are oftentimes based on contract rates, there will not be any refund for any unused portion of a travel booking. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed or the tour canceled.

CURRENCY FLUCTUATIONS
Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations, provided actual variations have occurred.

ALTERATIONS TO CONFIRMED BOOKINGS
If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you at our applicable administrative charge, depending upon circumstances of the request.

IMPORTANT INFORMATION FOR US DOMESTIC AIR TRAVELERS
The Federal Real ID Act mandates stricter security standards for state-issued driver’s licenses and other forms of identification and prohibits Federal agencies from accepting for official purposes identification that does not meet these standards. Beginning on May 7, 2025, every air traveler will need to present Real ID-compliant identification to be permitted to board a domestic flight; therefore, those holding a non-compliant driver’s license will need to present an acceptable alternate form of identification, such as a valid U.S. passport. To avoid disruption to their travel plans, air travelers are strongly encouraged to consult with the Department of Homeland Security (www.dhs.gov/real-id) to determine whether their state-issued identification is Real ID-compliant and, if not, what alternate forms of identification will be accepted at the airport.

HEALTH/SECURITY/TRAVEL DOCUMENTATION REQUIREMENTS
Each Customer is responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. VIVRE TRAVEL shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by Customer’s health practitioner on a valid vaccination certificate, which the Customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the USA State Department
Website http://travel.state.gov, for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues.

For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States visit http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.ustreas.gov, http://www.cbp.gov on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States especially your embassy and http://www.uscis.gov/ for non-USA citizens. (Customer is responsible to make VIVRE TRAVEL aware when traveling on a passport from a country other than the USA.)

AIRFARE
DISCLAIMER. Your contract for airfare is with the air carrier, inclusive of domestic, international and charter flights, and subject to its terms, conditions and policies and we will not be liable for any fees or expenses, including without limitation, change fees, cancellation fees or any other additional costs you incur with the air carrier. For charter trips/flights, please be aware the charter operator can legally change, with limited notice, departure times up to forty-eight (48) hours, and flights advertised as non-stop may be changed to make intermediate stops. Suppliers can substitute types of aircraft and even airlines and are generally not responsible for baggage delays/losses and have very stiff cancellation penalties. In addition, frequent flyer miles may or may not be accrued and advance seat assignments are frequently not available. VIVRE TRAVEL is not responsible or liable for any costs incurred with any changes resulting from any flights.

HAZARDOUS MATERIALS
USA federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) USA federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $25 0,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio-active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed in http://www.tsa.gov/traveler-information/prohibited-items and http://www.faa.gov/about/initiatives/hazmat_safety/.

INSECTICIDE NOTICE
All passengers are advised to always check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the DOT’s website, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

E-TICKETS
E-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
The Americans with Disabilities Act (“ADA”) is only applicable within the United States, and facilities for disabled individuals are limited outside its borders. A qualified and physically able companion must accompany travelers who need such assistance. Motorized scooters are unsuitable for many trips. Transportation services, including many tour motor coaches, are not equipped with wheelchair ramps.

VIVRE TRAVEL generally will attempt to honor prices as originally quoted;, however,; under certain circumstances additional costs by a supplier or government may be imposed for a variety of reasons, including, for example, an increase in the cost for one or more of the travel components. Prior to full payment, prices including US air transactions or air tours (in, to, or from the US) could increase for certain travel services, including the following: a seat, carriage of passenger baggage, applicable fuel surcharge, or an increase in a government-imposed tax or fee. US air transaction or air tour prices will not increase after making full payment, except for charges resulting from government-imposed taxes or fees. Certain suppliers reserve the right to increase prices to cover increased costs, fuel surcharges, tariffs and taxes, and to reflect fluctuations in foreign exchange markets. VIVRE TRAVEL generally will endeavor to notify Customer in the event that it becomes aware of a price increase that has not been discussed previously. In any event, Customer expressly acknowledges acceptance of the foregoing conditions applicable to purchase and authorizes VIVRE TRAVEL to charge Customer’s credit card for such additional amounts.

This consent applies to all travel arranged by VIVRE TRAVEL for Customer, and may be revoked at any time with respect to future travel for which Customer has not yet made payment. Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of VIVRE TRAVEL’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of VIVRE TRAVEL. VIVRE TRAVEL reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member any person of any tour at any time. VIVRE TRAVEL shall not assume any responsibility for any air and/or ground schedule changes.

VIVRE TRAVEL HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CUSTOMER AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM VIVRE TRAVEL WILL BE LIMITED TO THE COMMISSION AND FEES PAID BY CUSTOMER AND ACTUALLY RECEIVED BY VIVRE TRAVEL IN THE PAST TWELVE MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.

FORCE MAJEURE
VIVRE TRAVEL assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: natural disasters, fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, or any other acts of a similar nature, sabotage, cybersecurity issues and/or technology outages or disruptions, changes of schedules or operational decisions of air carriers, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (including, without limitation, COVID-19), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel Supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by VIVRE TRAVEL that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions (“force majeure”). In circumstances amounting to force majeure, we will not be required to refund any money to you, although if (and only if) we can recover any monies from our Suppliers (it being under no obligation to do so), we will refund these to you without any charge by VIVRE TRAVEL.

TRAVEL INSURANCE
VIVRE TRAVEL always recommends the purchase of travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency. If you know you want to decline travel insurance, you will expressly do so in writing via email or a form VIVRE TRAVEL will provide. Otherwise, we will provide you a quote for travel insurance directly or through our indirect affiliate partner’s insurance desk (Brownell) which you may purchase or decline.
VIVRE TRAVEL OFFERS ACCESS TO MANY OPTIONAL PRODUCTS AND SERVICES TO ENHANCE EVERY TRAVEL EXPERIENCE. OPTIONS SUCH AS TRAVEL INSURANCE PROTECT PASSENGERS AND THEIR INVESTMENT. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CUSTOMER’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.
Without appropriate travel insurance, Customer understands and agrees that if Customer cancels or interrupts Customer’s travel for any reason, portions of the trip/tour may not be refunded and VIVRE TRAVEL’s and travel supplier’s cancellation penalties will apply resulting in the loss of monies up to the full cost of Customer’s travel booking and related costs. The purchase of travel insurance is not required
in order to purchase any other product or service offered by VIVRE TRAVEL. Employees of VIVRE TRAVEL are not qualified or authorized to: answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for travel insurance selected.

ALTERATIONS IN TRAVEL PLANS
Alterations in itinerary may be necessitated for any number of reasons, including but not limited to severe weather at the sole discretion of VIVRE TRAVEL and subject to each supplier’s terms and conditions. If a property, supplier, activity, or area is deleted for any reason, it may be replaced with a comparable one.

PHOTOGRAPHS/VIDEOS
VIVRE TRAVEL reserves the right to use any photograph/video taken at any event or during any travel activity, without the express written permission of those included within the photograph/video. VIVRE TRAVEL may use the photograph/video in publications or other media material produced, used or contracted by VIVRE TRAVEL, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. Any person desiring not to have his/her photo taken or distributed must contact antoine@vivretravel.com in writing of his/her intentions and include a photograph.

COMMENT POSTINGS
You are solely responsible for your own comments, the consequences of posting those comments, and the consequences of any reliance by you on the comments of others. By submitting your comment, you hereby give VIVRE TRAVEL the right, but not the obligation, to post, edit, exhibit, webcast, re-use, publish, reproduce, use, license, print, distribute or otherwise use your comment(s) and accompanying personal identifying and other information you provide via all forms of media now known or hereafter devised, worldwide, in perpetuity. All Suppliers are independent contractors and are not Representatives of VIVRE TRAVEL. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each Supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither VIVRE TRAVEL, nor its Representatives are or may be liable for any loss, injury, or damage to any trip traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of VIVRE TRAVEL including in the event any third-party providers or healthcare professionals seek to assist with medical or other help and we are not liable for any costs or missed activities in relation to said assistance. VIVRE TRAVEL assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; VIVRE TRAVEL assumes no responsibility or liability for personal property; and VIVRE TRAVEL shall be entirely relieved of any obligations under these Terms and Conditions in the event of any force majeure. VIVRE TRAVEL accepts no responsibility for lost or stolen items. Further, VIVRE TRAVEL reserves the right to refuse any customer or potential customer at its sole discretion.

ASSUMPTION OF RISK/WAIVER
The travel that you are undertaking in connection with your trip inherently involves risks, some in remote areas of the world. These risks include, but are not limited to, risk of injury or death from: force majeure, motor and conveyance vehicle collisions, water related activities, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, VIVRE TRAVEL and its Representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, illnesses caused by COVID-19 (or other pandemics, infectious diseases, etc.), physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; equipment malfunctions; or a lack of safety features and/or failure to utilize any safety features.

Traveler understands the description of these risks is not complete and acknowledges that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip and in consideration of the services provided by VIVRE TRAVEL, traveler is willing to accept the risks and uncertainty involved as being an integral part of travel and is voluntarily participating in said travel with the knowledge that there are significant potential dangers and hereby agrees to accept any and all risks. FURTHER, TRAVELER HEREBY ACCEPTS AND ASSUMES FULL RESPONSIBILITY FOR ANY AND ALL RISKS OF ILLNESS, INJURY OR DEATH AND OF THE NEGLIGENCE OF VIVRE TRAVEL AND AGREES TO AND SHALL HOLD HARMLESS AND FULLY RELEASE VIVRE TRAVEL AND ITS REPRESENTATIVES FROM ANY AND ALL CLAIMS ASSOCIATED WITH THE TRIP, INCLUDING ANY CLAIMS OF THIRD PARTY NEGLIGENCE AND/OR THE NEGLIGENCE OF VIVRE TRAVEL AND/OR ITS REPRESENTATIVES, AND TRAVELER HEREBY COVENANTS NOT TO SUE VIVRE TRAVEL AND/OR ITS REPRESENTATIVES FOR ANY SUCH CLAIMS OR JOIN ANY LAWSUIT OR ACTION THAT IS SUING VIVRE TRAVEL. THIS AGREEMENT ALSO BINDS YOUR HEIRS, LEGAL REPRESENTATIVES, AND ASSIGNS. THE TERMS OF THIS HOLD HARMLESS AND RELEASE OF ALL LIABILITY PARAGRAPH, SHALL SURVIVE ANY TERMINATION OR CANCELLATION OF THESE TERMS AND CONDITIONS, WHETHER BY OPERATION OF LAW OR OTHERWISE.

INDEMNIFICATION
Traveler agrees to and shall indemnify and hold harmless VIVRE TRAVEL and its Representatives from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by VIVRE TRAVEL or its Representatives (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) your breach or violation, or threatened breach or violation, of these Terms and Conditions; (ii) any of your acts or omissions, including any damage caused by you to persons or property while participating in the trip, (iii) any force majeure or inherent risk of travel; or (iv) claims brought by third parties in connection with any of the foregoing. The terms of this INDEMNIFICATION paragraph shall survive any termination or cancellation of these Terms and Conditions, whether by operation of law or otherwise.

SECURITY AND PRIVACY
Any passwords used for registration on this website are for individual use only. You may not share your password with anyone. You are solely responsible for the security of your password and any use of the services by anyone else with whom you share your password. We may monitor your password and, at our sole discretion, require you to change it. If you use a password that we consider insecure, we may require it to be changed or we may end your account.

If you become involved in any violation of system security, we reserve the right to release your details to system administrators at other websites in order to assist them in resolving security incidents. We reserve the right to investigate all suspected violations of these Terms and Conditions.

You hereby certify that you are at least 18 years old. If you are under 18, please do not use www.vivretravel.com or any of our other services. We do not knowingly collect any personally identifiable information from any person under 18 years old.

CLASS ACTION WAIVER AND LIMITATION OF DAMAGES
YOU AGREE THAT YOU WILL ONLY BRING CLAIMS AGAINST VIVRE TRAVEL IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. VIVRE TRAVEL SHALL NOT IN ANY CASE BE LIABLE FOR OTHER THAN COMPENSATORY DAMAGES, AND YOUR PAYMENT OF A DEPOSIT ON A TRIP MEANS THAT YOU AGREE TO THESE CONDITIONS OF SALE AND EXPRESSLY WAIVE ANY RIGHT TO PUNITIVE DAMAGES. YOU FURTHER AGREE THAT IN NO EVENT SHALL VIVRE TRAVEL’S LIABILITY TO YOU (OR ANY MEMBER OF YOUR TRAVELING PARTY, OR YOUR/THEIR HEIRS, SUCCESSORS AND ASSIGNS), FROM ANY CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, INDEMNITY, EQUITY, OR OTHERWISE), EXCEED THE AMOUNTS PAID TO VIVRE TRAVEL FOR THE SERVICES VIVRE TRAVEL PERFORMED AND PROVIDED TO YOU IN CONNECTION WITH THESE TERMS AND CONDITIONS, AND THIS IS YOUR SOLE AND EXCLUSIVE REMEDY FOR A BREACH OF THESE TERMS AND CONDITIONS BY VIVRE TRAVEL.

JURY WAIVER AND NOTICE OF CLAIM/INTENTION TO COMMENCE ACTION YOU HEREBY AGREE TO WAIVE YOUR RIGHT TO TRIAL BY JURY. YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST VIVRE TRAVEL UNLESS YOU HAVE FIRST PROVIDED A WRITTEN NOTICE OF CLAIM TO VIVRE TRAVEL WITHIN THIRTY (30) DAYS AFTER THE TRIP OR CANCELLATION OF THE TRIP, FURTHER PROVIDED THAT YOU AGREE TO FILE SUIT WITHIN ONE (1) YEAR OF THE INCIDENT AND YOU ACKNOWLEDGE THAT THIS EXPRESSLY LIMITS THE APPLICABLE STATUTE OF LIMITATIONS TO ONE (1) YEAR.

GOVERNING LAW AND ARBITRATION
These Terms and Conditions shall be construed and enforced in accordance with the internal laws of the State of Wyoming. Any disputes that arise out of, pursuant to or in connection with, these Terms and Conditions, and your use of the services of VIVRE TRAVEL, shall be handled in a competent court in Wyoming.. Any controversy of claim or dispute arising out of or relating to these Terms and Conditions, or the breach thereof, shall be settled in a competent court in Wyoming. The substantially prevailing party shall be entitled to his or her reasonable attorney’s fees and associated costs paid by the other party. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity or enforceability of any remaining provisions. Use of the VIVRE TRAVEL website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms and Conditions, including, without limitation, this paragraph. These Terms and Conditions constitute the entire agreement relating to this subject matter. Notwithstanding the foregoing, any additional terms and conditions on this website will govern the items to which they apply. We may revise these Terms and Conditions at any time.
